LILBURN, Ga. (AP) — A former Lilburn police officer has been indicted on charges that he inappropriately touched and videotaped a woman while on duty.

The Atlanta Journal-Constitution reports a Gwinnett County grand jury indicted 34-year-old Gary Livingston on Wednesday on two counts of unlawful surveillance and individual counts of simple battery and violation of oath of office.

Police say in a statement Livingston and another officer responded to an alarm call May 25 at a local apartment complex. After determining it was a false alarm, authorities say Livingston had the 31-year-old female property manager participate in what he called a psychology experiment by pretending to be asleep as he touched her. The woman called 911 shortly afterward and Livingston was fired three weeks later.

It’s unclear whether he has an attorney.
