OPELIKA, Ala. (AP) – A judge is delaying a decision on whether to delay the ethics trial of House Speaker Mike Hubbard.
Circuit Judge Jacob Walker said during a hearing Tuesday in Opelika he wasn’t inclined to grant a defense request to postpone the trial from March until fall.
However, Walker also says he’s uncertain about bringing in jurors considering his pretrial rulings could be appealed.
The hearing is continuing.
Prosecutors and defense lawyers argued over Hubbard’s request to delay the trial after the sudden withdrawal of his lead attorney. Defense lawyer Lance Bell says the remaining lawyers have small firms and couldn’t be ready by the March 28 trial date.
Prosecutor Matt Hart says the case had been delayed twice and citizens deserve a resolution to charges against the prominent politician.
